2. What information we collect
We collect personal data in two ways:
Information you give us: when you complete a contact form, request a brief, subscribe to updates or otherwise correspond with us, you may provide your name, business email address, telephone number, company name, job title and the details of your enquiry or brief.
Information collected automatically: when you visit this website we may collect technical data such as your IP address, device type, browser, referring page, pages visited and approximate location. This is collected through our hosting and analytics providers.
3. Lawful basis for processing
We rely on the following lawful bases under UK GDPR:
- Legitimate interests: to respond to enquiries, run and improve our website, prevent fraud, and operate our business as a media agency. We have balanced these interests against your rights.
- Consent: for marketing communications. You can withdraw consent at any time.
- Contract: to perform a contract with you or take steps at your request before entering into a contract.
- Legal obligation: where we are required to retain or disclose information by law.
4. How we use your information
We use personal data to:
- Respond to enquiries, briefs and proposal requests;
- Deliver and account for the campaigns and services we are engaged to run;
- Operate, maintain and secure this website and our internal systems;
- Send service updates and, where you have consented, marketing communications;
- Comply with our legal, regulatory and accounting obligations.
5. Direct marketing and electronic communications
Where we send marketing emails, SMS messages, or make telephone calls on our own behalf or on behalf of our clients, we comply with the Privacy and Electronic Communications Regulations 2003 (PECR) and the ICO's direct marketing code of practice. In particular:
- Email and SMS marketing: we contact business email addresses under the soft opt-in (PECR reg. 22) where the recipient is an existing business contact and the communication relates to similar services, or otherwise on the basis of a freely-given, specific and informed consent. Every electronic marketing message includes a clear, free unsubscribe option.
- Telephone marketing: outbound business calls are screened against the Corporate Telephone Preference Service (CTPS), and consumer calls against the Telephone Preference Service (TPS), in accordance with PECR reg. 21.
- Unsubscribe: to stop receiving marketing communications from us at any time, click the unsubscribe link in any email, reply “STOP” to any SMS, or email unsubscribe@mediaaddict.co.uk. Suppression is honoured within five working days.
6. Who we share information with
We share personal data only with trusted third parties acting as data processors on our behalf, under written data processing agreements. These include hosting providers, database providers, email and SMS delivery providers, analytics providers and other operational suppliers. We do not sell personal data and we do not share it for third-party advertising.
Where we are engaged to provide services for a client and personal data is collected on the client's behalf (for example, lead-generation campaigns), Media Addict Limited acts as a processor and the client is the controller. In those engagements we operate under a written Data Processing Addendum (DPA) compliant with UK GDPR Article 28. A copy of our standard DPA is available on request from hello@mediaaddict.co.uk.
We may disclose information where required by law, by a regulator, or to protect our legal rights.
7. International transfers
Some of our suppliers are based outside the UK, including in the European Economic Area, the United States and Canada. Where personal data is transferred outside the UK, we rely on the UK's adequacy regulations, the UK International Data Transfer Agreement, or the EU Standard Contractual Clauses with the UK Addendum, together with appropriate supplementary safeguards.
8. How long we keep your information
We keep personal data only for as long as is necessary for the purposes set out in this policy. Enquiry data is typically retained for up to 24 months after our last meaningful contact with you. Data relating to a contracted engagement is retained for the duration of the contract and for the periods required by tax, accounting and other legal obligations.
